Terms of Service

Welcome to Art4IRA! These Terms govern your use of our website and services. Because Art4IRA is used by minors, a parent or legal guardian must agree to these Terms on behalf of any child using the service. If you do not agree, please do not use Art4IRA.

1. The service

Art4IRA provides an online platform that allows young artists (ages 6–17), under the supervision of a parent or legal guardian, to upload and sell original digital artwork, track earnings, and receive year-end tax documentation that can be used to fund a custodial Roth IRA through a third-party custodian. We refer to these features collectively as the "Service."

2. Accounts

2.1 Parent accounts

Parents or legal guardians (18+) must create and own the primary account. The parent is responsible for all activity under their account and all associated child profiles, including providing accurate information, keeping login credentials secure, and complying with applicable law.

2.2 Child profiles

Parents may create sub-profiles for their children. By doing so, the parent represents that they are the child's legal parent or guardian and consents to the child's use of the Service under these Terms and our Privacy Policy. Parents supervise, approve listings where required, and control withdrawals.

2.3 Eligibility

The Service is intended for U.S. residents. You must have the legal capacity to enter into these Terms.

4. Fees & payouts

Art4IRA charges a platform fee on each sale, which is disclosed before any listing is published. The fee covers payment processing, hosting, fraud prevention, and tax reporting. Remaining proceeds are credited to the account and may be withdrawn by the parent, subject to identity verification and applicable holding periods.

5. Taxes & Roth IRA contributions

Earnings from selling art are generally treated as self-employment income for the child and may be subject to federal and state taxes. Art4IRA provides year-end statements summarizing sales, fees, and net earnings to help you meet your reporting obligations.

Art4IRA does not open or administer Roth IRAs. We provide educational resources and, where available, referrals to third-party custodial IRA providers. The decision to open a Roth IRA, how much to contribute, and all investment decisions belong solely to the parent or guardian. You are responsible for complying with all IRS rules, including earned-income and contribution-limit requirements.

All Art4IRA software, branding, designs, and content (excluding user-uploaded art) is owned by Art4IRA and protected by intellectual property laws. You may not copy, modify, or distribute our materials without permission.

8. Termination

You may close your account at any time by emailing info@art4ira.com. We may suspend or terminate accounts that violate these Terms or pose a risk to the platform or its users. Upon termination, outstanding earnings (minus applicable fees and any amounts required by law) will be paid out to the account on file, and listings may be removed.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE ANY PARTICULAR LEVEL OF SALES, EARNINGS, OR INVESTMENT RETURNS. PROJECTIONS AND CALCULATOR OUTPUTS ARE ILLUSTRATIVE ONLY.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ART4IRA WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

You agree to indemnify and hold Art4IRA and its affiliates harmless from any claim or demand arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right, including claims related to user-uploaded content.

12. Dispute resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Any dispute will be resolved by binding arbitration in Delaware, except that either party may bring claims in small-claims court where eligible. You and Art4IRA agree to resolve disputes only on an individual basis; class actions are waived to the extent permitted by law.

13. Changes to these Terms

We may update these Terms from time to time. If the changes are material, we'll notify you by email or via the Service. Continued use after the effective date means you accept the new Terms.
